Syria peace progress rests with U.N. Security Council: mediator

UNITED NATIONS (Reuters) - International Syria mediator Lakhdar Brahimi said on Thursday he could not move forward with a peace plan unless it was backed by a U.N. Security Council resolution and he warned that a ceasefire would only hold if it was overseen by a peacekeeping mission.

A peaceful solution to the 20-month conflict could only be initiated by the Security Council, Brahimi told the 15-member body, which has been deadlocked on whether to take stronger action against Syrian President Bashir al-Assad.

"I have been challenged to produce a plan. I think that we now have the elements of a plan, but these elements cannot be put together until this council has come together and is ready to adopt a resolution that will be the basis for a political process (in Syria)," Brahimi told reporters after his briefing.

The United States and European council members blame Russia, a staunch ally and key arms supplier for Assad's government, and China for the council's inaction on the conflict. Moscow and Beijing have vetoed three resolutions condemning Assad and reject the idea of sanctioning his government.

"No doubt what is very, very urgently needed is a ceasefire that can hold ... a ceasefire will not hold unless it is very, very strongly observed, and that, I believe, will require a peacekeeping mission," Brahimi said.

If there were a more sustained ceasefire, the U.N. Department of Peacekeeping Operations has told Brahimi it could put together a force of up to 3,000 monitors to keep fighters separated and maintain the truce, diplomats say.

Under a truce in April brokered by Brahimi's predecessor, former U.N. Secretary-General Kofi Annan, some 300 monitors and about 100 civilian experts were deployed to Syria to oversee the ceasefire that failed to take hold. As the conflict worsened, the Security Council allowed the force's mandate to lapse and the unarmed monitoring team withdrew in August.

'NEW SYRIA'

A Syrian revolt against Assad began as peaceful rallies calling for more freedoms and democracy, but it turned into an armed struggle after the military cracked down on protesters. It has killed about 40,000 people, making it the bloodiest of Arab uprisings that have ousted entrenched leaders in Tunisia, Egypt, Libya and Yemen since early last year.

Brahimi wants the Security Council to pass a resolution based on a deal reached by world powers in June to set up a transitional government in a bid to end the bloodshed. [ID:nL5E8M46GZ] "The new Syria will not look like the Syria of today," he said.

Russian U.N. Ambassador Vitaly Churkin said Moscow vetoed an attempt this year to back the deal with a resolution because it had been rewritten to be become an "instrument of further confrontation and building up tensions in Syria, putting more pressure on the Syrian government."

He said Russia was prepared to hold consultations on a resolution to bring about a political solution because "a military solution is not really working." But he again ruled out sanctions against Assad's government.

"Some say 'well, if we threaten more sanctions to the government, then they will do something about it.' We do not really buy that," Churkin told reporters. "There is as much pressure as one can think of in terms of where the Syrian government finds itself right now."

"We need really to find responsible people on both sides who need to realize that its time for them ... to enter into dialogue. Incidentally, we are not saying that President Assad should be sitting at the table," he said.

Syrian U.N. Ambassador Bashir Ja'afari again accused "foreign hands interfering in the domestic affairs of my country Syria" and called for the violence to stop.

(AP) ? CNN on Thursday named former NBC Universal chief Jeff Zucker as its new top executive, searching for a way to turn around the original cable news network as it has lagged behind rivals Fox News Channel and MSNBC.

Zucker will start in January, based in New York and reporting to Phil Kent, who runs all of the Turner networks for parent company Time Warner.

"I spent the most rewarding years of my career as a journalist, and it's where I look forward to spending many more," said Zucker, who shot to fame as the executive producer of NBC's "Today" show at the start of its morning dynasty in the 1990s.

Zucker moved on to Hollywood as NBC's entertainment president, where he was less successful. He became head of NBC Universal, and while he couldn't turn around NBC, achieved great financial success for the company by overseeing its highly profitable cable networks.

One of them was MSNBC, which has become more successful by appealing to a partisan audience, following the model of the market leader at Fox News Channel. CNN has steadfastly maintained a non-biased approach and its biggest issue has been the same as it has been for two decades: how to get an audience to stay with the network when there is not a big news story dominating the public's attention.

While a great deal of attention has been paid to CNN's problems in prime time for its domestic network, Zucker will command a much larger and more successful portfolio, including HLN, CNN International and the CNN.com website. A CNN product is in televisions on some 265 million homes across the world.

Zucker has been seen as the lead candidate for the job since his predecessor, Jim Walton, announced in the summer he was leaving. Zucker has spent the past year helping Katie Couric put her talk show on the air.

"Jeff's experience as a news executive is unmatched for its breadth and success," Kent said. "He built and sustained the number-one brand in morning news, and under his watch NBC's signature news programming set a standard for quality and professionalism."

Tom Johnson, president of CNN during the 1990s, said it was a "splendid choice."

"I would hope it would be a return to CNN where news trumps all programming so CNN gets back to its basics of being a breaking news network," Johnson said.

PFT: Suh won't apologize, says kick was accidental

Carolina Panthers v Philadelphia EaglesGetty Images

With 176 games completed, the gap has been cut from seven to two.

After a four-game sweep of our disagreements in Week 11, MDS posted another 3-1 mark in Week 12, making it very interesting over the final five weeks.

This week, we have only one disagreement.? So it?ll be down to one or back to three by Monday.? (I are good at the math.)

Of course, that doesn?t mean we?ll be right on the picks on which we agree.? But we?re doing OK.? MDS was 11-5 for Week 12, and I was 9-7.? For the season, I?m at 112-63-1, a 63.6 percent accuracy rate.? MDS is 110-65-1, which equates to 62.5 percent.

Saints at Falcons

MDS?s take: It sounds crazy to say this about a 5-6 team facing a 10-1 team, but right now the Saints are playing better football than the Falcons. Having said that, I have a hunch the Falcons will turn in their best effort of the season at home against the team that gave them their only loss.

MDS?s pick: Falcons 28, Saints 21.

Florio?s take:? An already contentious rivalry will become even more contentious now that eggs have flown into the Saints bus and former Falcons linebacker Curtis Lofton has declared that his new team, the Saints, don?t regard the rivalry as a rivalry, given that the Saints have won 11 of 13.? With the Falcons closing in on a playoff berth and sensitive about the perception that they can?t win big games at home, it?s time to drop the Saints? mark against the Falcons to 11 of 14.

Florio?s pick:? Falcons 27, Saints 24.

Jaguars at Bills

MDS?s take: Jaguars quarterback Chad Henne has been impressive enough since replacing Blaine Gabbert that I?m tempted to pick the Jags to pull off a home upset. But these are still the Jaguars, and even if Henne has improved the offense, they still have a terrible defense, plus the Bills have a big special teams edge.

MDS?s pick: Bills 27, Jaguars 23.

Florio?s take:? The Jags are riding a rare one-game winning streak.? The Bill are trying to break a not-so-rare one-game losing streak.? Home team gets the advantage, even though the Jaguars are better with Chad Henne at quarterback.

Florio?s pick:? Bills 24, Jaguars 17.

Seahawks at Bears

MDS?s take: This might be the day?s most interesting game, especially if you enjoy watching teams that play tough, physical defense. I think Seattle?s defensive front has the potential to make life a nightmare for Jay Cutler playing behind the Bears? woeful offensive line, and yet the Seahawks have struggled so much away from home that I?m taking the Bears in a close one.

MDS?s pick: Bears 14, Seahawks 13.

Florio?s take:? It?s chicken salad time for the Chicago offensive line, with failed first-round tackle Gabe Carimi being pressed into service at guard.? But Jay Cutler knows how to avoid the pressure and deliver the ball, and the Seahawks still haven?t learned how to win on the road.

Florio?s pick:? Bears 23, Seahawks 13.

Colts at Lions

MDS?s take: The Lions are playing better football than their record suggests, while the Colts are playing worse football than their record suggests. I still think Indianapolis will be a wild card team, but in this game Calvin Johnson will have a huge day against a weak secondary.

MDS?s pick: Lions 31, Colts 20.

Florio?s take:? Assuming that the Lions haven?t folded the tents after a season-crushing Thanksgiving loss, they?ve got the horses to hold off a Colts team that has yet to learn how to win away from Indy consistently.

Florio?s pick:? Lions 27, Colts 20.

Vikings at Packers

MDS?s take: Green Bay had a letdown against the Giants last week, but that won?t happen again. This is the game when the Packers pull ahead of the pack in the NFC wild card race, as well as staying within striking distance of the Bears in the NFC North.

MDS?s pick: Packers 34, Vikings 13.

Florio?s take:? Minnesota has embarked on its long-expected late-season collapse, and the Packers will be extra salty after getting peppered by the Giants.? This one could get ugly.

Florio?s pick:? Packers 34, Vikings 13.

Panthers at Chiefs

MDS?s take: It?s too late for the Panthers to get back in the playoff race, but I do see them going on a little bit of a late-season run. With Cam Newton playing well, they?ll easily win in Kansas City.

MDS?s pick: Panthers 27, Chiefs 9.

Florio?s take:? The Chiefs can?t lose every game the rest of the season, can they?? Carolina is on the road after a Monday night on the road, cramming two rounds of travel into a short week after a game in which they are feeling better about themselves than they should.? The Chiefs, if they don?t win this one, may not win another.? Ever.

Florio?s pick:? Chiefs 20, Panthers 16.

Patriots at Dolphins

MDS?s take: I like a lot about the way the Dolphins are playing, especially defensively. And the Patriots? secondary has a bad tendency to leave receivers wide open, so Ryan Tannehill may have a decent statistical game. But New England?s offense is such a well-oiled machine that I like the Patriots to get into the end zone five or six times.

MDS?s pick: Patriots 38, Dolphins 28.

Florio?s take:? The Dolphins will win if the sprinklers come on again.? And if the are loaded with hydrochloric acid and aimed at the eyes of Tom Brady and Bill Belichick.? Otherwise, advantage Pats.

Florio?s pick:? Patriots 35, Dolphins 24.

Cardinals at Jets

MDS?s take: This is a stinker of a game between two teams with all kinds of problems at the quarterback position, but it says something about how far the Cardinals have sunk that Mark Sanchez is easily the top quarterback in this game.

MDS?s pick: Jets 20, Cardinals 10.

Florio?s take:? It?s easy to assume the Jets will continue their implosion.? The schedule suggests they could win five in a row.? They may not get to 9-7, but 5-7 is looking pretty promising.

Florio?s pick:? Jets 30, Cardinals 17.

49ers at Rams

MDS?s take: I don?t think this game is going to be easy for the 49ers because St. Louis isn?t an easy place to play anymore, but in the end San Francisco just has too much power on both sides of the ball for the Rams to have much of a chance.

MDS?s pick: 49ers 24, Rams 13.

Florio?s take:? They pick up where they left off after five quarters that ended in a tie.? The Rams try to extend their 3-0-1 record in the NFC West.? The Niners are simply a better team with Colin Kaepernick at quarterback.

Florio?s pick:? 49ers 31, Rams 23.

Texans at Titans

MDS?s take: The Titans fired offensive coordinator Chris Palmer this week, as if that will fix anything. The Titans? problems go much deeper than the offensive playcalling, and the Texans ? getting a well deserved three extra days of rest following their back-to-back overtime games the last two weeks ? will look fresh and win this one handily.

MDS?s pick: Texans 41, Titans 20.

Florio?s take:? Yes, before the season I thought the the Titans, who were unexpectedly 9-7 in 2011, were poised to topple the Texans.? It hasn?t happened.? And it won?t happen for the Titans on Sunday, not with the Texans closing in on their second straight playoff berth.

Florio?s pick:? Texans 27, Titans 14.

Buccaneers at Broncos

MDS?s take: The Bucs are thin in the secondary after trading away Aqib Talib and losing Eric Wright to a suspension, and Peyton Manning is the last quarterback you want to face when you?re thin in the secondary. Manning will pick the Bucs? defense apart. The best chance the Bucs have of keeping this game close is to control the ball by running Doug Martin, but in the end Manning will just have too much for Tampa Bay.

MDS?s pick: Broncos 35, Buccaneers 24.

Florio?s take:? With Eric Wright suspended and Aqib Talib long gone, it?ll be a long day for the Bucs? porous pass defense.

Florio?s pick:? Broncos 31, Buccaneers 21.

Steelers at Ravens

MDS?s take: The Steelers need this one, but they?re not going to get it. Without Ben Roethlisberger the Steelers just aren?t a very good team, and I expect the Ravens to earn a big win that helps them pull away in the AFC North.

MDS?s pick: Ravens 23, Steelers 7.

Florio?s take:? With or without Ben Roethlisberger, the Ravens are tough to beat at home.? And even though it would be fitting for the Steelers to win in Baltimore after the Ravens won in Pittsburgh, the Ravens are the better team ? and the Steelers are on the verge of a late-season implosion.? All that?s left is for coach Mike Tomlin to vow to ?unleash hell.?

Florio?s pick:? Ravens 19, Steelers 13.

Browns at Raiders

MDS?s take: Both teams are 3-8, but they?re a different 3-8. The Browns are a 3-8 team that is playing competitive football and has a lot of young guys who look hungry. The Raiders are a 3-8 team that just wrapped up an 0-4 November in which their four losses came by a total of 90 points. The Browns will go into the Black Hole and come out with their first road win of the season.

MDS?s pick: Browns 21, Raiders 17.

Florio?s take:? The Browns are better than their record suggests.? The Raiders are worse.? With Browns players trying to save the job of their head coach (and in turn their own jobs), Cleveland has more incentive to try to emerge with a win.

Florio?s pick:? Browns 17, Raiders 13.

Bengals at Chargers

MDS?s take: The Bengals are rolling and the Chargers are reeling. Marvin Lewis will take another step toward the playoffs while Norv Turner takes another step toward the unemployment line.

MDS?s pick: Bengals 24, Chargers 14.

Florio?s take:? San Diego?s AFC North tour continues, and they wish it wouldn?t.? After losing to the Browns and to the Ravens, a surging Cincinnati team is ready to keep pushing toward their first consecutive playoff appearances in non-strike years.

Florio?s pick:? Bengals 27, Chargers 17.

Eagles at Cowboys

MDS?s take: The Eagles have given up on the season. At this point I don?t think I?d pick them to beat anyone, and I certainly won?t pick them to win on the road against a Cowboys team that still has slim playoff hopes.

MDS?s pick: Cowboys 28, Eagles 20.

Florio?s take:? Philly is in a full-blown free fall.? After seeing them lose to the lowly Panthers, I?m done picking them until next September at the earliest.? The Cowboys aren?t much better, but they?re good enough (and sufficiently healthier) to get it done.

Florio?s pick:? Cowboys 34, Eagles 20.

Giants at Redskins

MDS?s take: The Redskins have done a great job of pulling themselves back into NFC East contention, and if you want to see an interesting playoff race in December you should be rooting for the Redskins to beat the Giants on Monday night. But Robert Griffin III playing so well as a rookie has masked the fact that the Redskins have big problems on both sides of the ball. The Giants will be too much for them.

MDS?s pick: Giants 34, Redskins 17.

Florio?s take:? The Giants have awoken from their slumber.? That may not be enough to contain a streaking RG3 in his Monday night debut.? Forced to make a choice, however, let?s stick with the team that has shown that it still has the ability to periodically play up to its potential.? Especially when it has to.

Florio?s pick:? Giants 31, Redskins 27.

A big disconnect as 'fiscal cliff' clock ticks

(AP) ? Republicans' newfound willingness to consider tax increases to avert the "fiscal cliff" comes with a significant caveat: larger cuts than Democrats seem willing to consider to benefit programs like Medicare, Medicaid and the president's health care overhaul.

The disconnect on benefit programs, coupled with an impasse between Republicans and the White House over raising tax rates on upper-bracket earners, paints a bleak picture as the clock ticks toward a year-end fiscal debacle of automatic spending increases and harsh cuts to the Pentagon and domestic programs.

Democrats emboldened by the election are moving in the opposite direction from the GOP on curbing spending, refusing to look at cuts that were on the bargaining table just last year. Those include any changes to Social Security, even though President Barack Obama was willing back then to consider cuts in future benefits through lower cost-of-living increases. Obama also considered raising the eligibility age for Medicare, an idea that most Democrats oppose.

"I haven't seen any suggestions on what they're going to do on spending," a frustrated Sen. Orrin Hatch, R-Utah, said Tuesday. "There's a certain cockiness that I've seen that is really astounding to me since we're basically in the same position we were before."

Well, says Obama's most powerful ally on Capitol Hill, the Democrats are willing to tackle spending on entitlement programs if Republicans agree to raise income tax rates on the wealthiest Americans ? a nonstarter with Republicans still in control of the House.

"We hope that they can agree to the tax revenue that we're talking about, and that is rate increases, and as the president's said on a number of occasions, we'll be happy to deal with entitlements," Senate Majority Leader Harry Reid, D-Nev., said Tuesday.

But Reid speaks only in the most general terms, wary of publicly embracing specific ideas like boosting Medicare premiums or raising the program's eligibility age.

At the White House, Obama met with more than a dozen small business owners. Participants described the hour-long meeting as a listening session for Obama, with the business owners urging him to reach an agreement.

"They had one message for the president, which is they need certainty. Please get this deal done as soon as possible. They very much want consumers out there knowing that they're going to have money in their pockets to spend. That's why it's so important to pass the extension of the tax cuts for 98 percent of consumers, 97 percent of all small businesses," said Small Business Administration head Karen Mills.

Obama hits the road on Friday, visiting a Pennsylvania toy factory and broadcasting his case to extend current tax rates for all but those families making more than $250,000 a year.

Private White House negotiations with top aides to House Speaker John Boehner, R-Ohio, and others are cloaked in secrecy, with no evidence of headway.

"There's been little progress with the Republicans, which is a disappointment to me," Reid, a key negotiator, told reporters on Tuesday. "They talked some happy talk about doing revenues, but we only have a couple weeks to get something done. So we have to get away from the happy talk and start talking about specific things."

Republicans say it's Obama and his Democratic allies on Capitol Hill who are holding back, and they point to a balance of power in official Washington that is little changed by the president's re-election. Republicans still control the House, despite losing seats in the election. Democrats control the Senate.

"Democrats in Congress have downplayed the danger of going over the cliff and continue to rule out sensible spending cuts that must be part of any significant agreement to reduce the deficit," said Michael Steel, spokesman for House Speaker John Boehner, R-Ohio.

Just last year, Obama and top Democrats were willing during budget negotiations with Republicans to take politically risky steps such as reducing the annual inflation adjustment to Social Security retirement payments and raising the eligibility age for Medicare, which provides health care coverage to the elderly.

Now, with new leverage from Obama's election victory and a playing field for negotiations that is more favorable to Democrats than during the talks of the summer of 2011, Democrats are taking a harder line, ruling out any moves on Social Security and all but dismissing ideas like raising the eligibility age for Medicare from 65.

"The election spoke very strongly about the fact that the American people don't want to cut these programs that actually really sustain the middle class in America and allow people to become part of the middle class," said Sen. Tom Harkin, D-Iowa.

"I think they feel somewhat emboldened by the election," said GOP Rep. Tom Price of Georgia. "How could you not when your president is re-elected after running straight years of trillion dollar-plus deficits?"

Indeed, Obama could be in position to blame Republicans if an impasse results in the government going over the fiscal cliff. Democrats already are portraying GOP lawmakers as hostage-takers willing to let tax rates rise on everyone if lower Bush-era tax rates are not extended for the top 2 percent to 3 percent of earners ? those with incomes above $200,000 for individuals and $250,000 for joint filers.

"One thing Republicans have to realize ? we're in much better shape in January," said Harkin, referring to a time when taxes would have already risen and Democrats would be offering to cut taxes for all but the wealthiest Americans. "Fiscal cliff? I don't care."

Obama's opening position in the negotiations calls for $1.6 trillion in higher taxes over the coming decade, balanced by just $340 billion in cuts to rapidly growing health care programs, generally taken from health care providers instead of beneficiaries. That balance would have to change for Republicans to sign onto any agreement.

Given the crunch of time and the complexity of issues such as tax reform and wringing savings from programs like Medicare, negotiators are working on a two-track process: an initial "down payment" of deficit cuts next month, coupled with work next year on overhauling the tax code and curbing entitlement programs.

Sen. Dick Durbin, D-Ill., a leading Senate liberal and a member of Obama's special 2010 deficit panel ? which drafted a bold deficit reduction plan blending painful entitlement cuts with $2 trillion in higher tax revenues ? weighed in with a demand that any short-term down payment avoid politically sensitive safety net programs.

"Progressives should be willing to talk about ways to ensure the long-term viability of Social Security, Medicare and Medicaid, but those conversations should not be part of a plan to avert the fiscal cliff," Durbin said in a speech at the liberal Center for American Progress think tank in Washington.

Scott Applewhite)

WASHINGTON (AP) ? Three Republican senators said Tuesday they are more troubled than ever with comments made days after the deadly Sept. 11 raid in Libya by Susan Rice, the U.N. ambassador and President Barack Obama's possible choice for secretary of state.

Sens. John McCain, Lindsey Graham and Kelly Ayotte met privately with Rice and acting CIA Director Michael Morell for more than an hour on her much-maligned explanations of the attack on the U.S. diplomatic post in Benghazi, Libya, that killed the U.S. ambassador and three other Americans.

Rice told the lawmakers that the initial assessment of the cause of the attack five days later was wrong.

"The talking points provided by the intelligence community, and the initial assessment upon which they were based, were incorrect in a key respect: There was no protest or demonstration in Benghazi," Rice said in a statement after the meeting. "While we certainly wish that we had had perfect information just days after the terrorist attack, as is often the case the intelligence assessment has evolved."

She insisted that there was no intention to mislead the American people, and the administration updated Congress as the assessment evolved. The senators, though, were not mollified.

"We are significantly troubled by many of the answers that we got and some that we didn't get concerning evidence that was leading up to the attack on the consulate and the tragic death of four brave Americans and whether Ambassador Rice was prepared, or informed sufficiently, to give the American people the correct depiction of the events that took place," McCain told reporters.

Said Graham: "Bottom line I'm more disturbed now than I was before that 16 September explanation."

The three insisted that they need more information about the Libyan raid before they even consider Rice as a possible replacement for Clinton.

"I'm more troubled today," said Ayotte, who argued that it was clear in the days after the attack that it was terrorism and not a spontaneous demonstration prompted by an anti-Muslim video.

At the White House, spokesman Jay Carney said there were "no unanswered questions about Rice's appearance on the Sunday shows and the talking points that she used that were provided by the intelligence community. Those questions have been answered."

Carney called the focus on Rice's appearance on the Sunday shows an "obsession."

Despite lingering questions over her public comments after the Benghazi attack, Rice has emerged as the front-runner on a short list of candidates to succeed Clinton, with Sen. John Kerry, D-Mass., seen as her closest alternative.

The strong statements from the three senators clouded Rice's prospects only two days after Republican opposition seem to be softening. Rice planned meetings on Wednesday with Sen. Bob Corker of Tennessee, who is in line to become the top Republican on the Foreign Relations Committee, and Sen. Susan Collins, R-Maine.

Corker said Tuesday that he had concerns with a possible nomination.

"When I hear Susan talk she seems to me like she'd be a great chairman of the Democratic National Committee," Corker said. "There is nobody who is more staff supportive of what the administration does. That concerns me in a secretary of state."

Rice's series of meetings on Capitol Hill will be a critical test both for Republicans, who will decide whether they can support her, and the administration, which must gauge whether Rice has enough support to merit a nomination.

A senior Senate aide said the administration was sounding out moderate members of the Senate Foreign Relations Committee, such as Corker and Sen. Johnny Isakson, R-Ga. Assessing the prospects for Rice before Obama makes any announcement would avoid the embarrassment of a protracted fight with the Senate early in the president's second term and the possible failure of the nominee.

On talk shows the weekend following the attack, which took place on the 11th anniversary of 9/11, Rice was given talking points that described the attack as a spontaneous protest of the film, even though the Obama administration had known for days that it was a militant assault.

Republicans called her nomination doomed, leading to a vigorous defense of her by Obama in his first postelection news conference. Since then, GOP lawmakers have appeared to soften their views. McCain, who said earlier this month that would he do everything in his power to scuttle a Rice nomination, said Sunday that he was willing to hear Rice out before making a decision.

Sen. Jim Inhofe, R-Okla., a member of the Senate Foreign Relations Committee, had issued a statement highly critical of Rice on the day of Obama's news conference. He indicated Monday that perhaps she didn't know what had transpired in Benghazi on the day of the attack.

"I assumed she had full knowledge of everything that went on. I'm not at all convinced of that now. She very well could have been thrown under the bus," Inhofe said in an interview. He said she hadn't requested a meeting but he would be glad to meet with her.

White House spokesman Jay Carney said Monday that the administration appreciated McCain's latest comments about Rice, but wouldn't say whether the president saw them as an opening to make the nomination. "Ambassador Rice has done an excellent job at the United Nations and is highly qualified for any number of positions," Carney said.

Several diplomats currently serving with Rice said that what she lacked in Clinton's star power, she could make up with a blunter approach that demands attention and has marked her tenure thus far at the United Nations.

Rice, who at 48 is relatively young, has been known to covet the job for years, but was passed over for Clinton in 2009.

Compliance code of India: Legal and tax compliance

In many cases, especially with new companies setting up operations in India, significant compliance codes need to be followed. The compliance teams in a law firm provide such legal services during the formation and setting up phase. The compliances code includes corporate, tax and regulatory compliances.

Legal Compliance in India

Legal compliance is the process or procedure to ensure that an organization follows relevant laws, regulations and business rules. The definition of legal compliance, especially in the context of corporate legal departments, has recently been expanded to include understanding and adhering to ethical codes within entire professions, as well. There are two requirements for an enterprise to be compliant with the law, first its policies need to be consistent with the law. Second, its policies need to be complete with respect to the law. The role of legal compliance has also been expanded to include self-monitoring the non-governed behavior with industries and corporations that could lead to workplace indiscretions. It is also important to realize that within the legal compliance framework, legal teams work closely with executive teams and other business departments to align their goals and ensure proper communication.

Legal Compliance Manual

Legal Compliance Manual put together by the Indian Institute of Corporate Affairs (IICA) contains a list of compliances required to be carried out on the part of businesses that arise under various central and state legislation.

The Legal Compliance Manual is divided into various sub-categories to cover respective legal requirements, namely:

  • Corporate
  • Environment
  • Labour
  • Tax
  • General
  • It is indeed a useful tool for practitioners and businesses given the plethora of legal compliance required on their part while operating in India.

    Tax Compliance in India
Tax compliance is a complex phenomenon that is governed by a variety of factors. Some of these factors are tax rates, complexity of laws, procedures, forms and returns, the efficiency of tax administration including tax audits, and the legal consequences of non-compliance. The reforms in indirect taxes in the last two decades may have reduced the cost of compliance. Herein, the compliance cost is taken as a percentage of the total cost of running the business.

    Tax Compliance Review
Tax Compliance Review (TCR) is an audit of the compliance requirements of tax laws covering besides correct payment of taxes and duties, complete availing of concessions, benefits, subsidies, exemptions and credits. TCR is a mechanism to ensure correct payment of taxes and helps businesses devise sound strategies for smooth functioning within the framework of different laws. In most businesses, in-house expertise is not sufficient to achieve these objectives. Fortified by a strong background in tax laws and litigation, Lakshmikumaran&Sridharan undertakes high-quality TCRs for clients.

TCR enables clients to maximize benefits, identify opportunities and exposures for taking corrective action. It ensures correct payment of duties/taxes, assessment of the training requirements and changes required in the business processes. The TCR team works closely with clients to understand their particular needs and deliver specific solutions.

Apple's Eddy Cue reportedly fires Richard Williamson, who oversaw the iOS 6 Maps team

Apple's Eddy Cue reportedly fires Richard Williamson, who oversaw the team responsible for iOS 6 Maps

We aren't apt to ever hear this in official fashion, but Bloomberg has it on good authority that Apple's newly-promoted Eddy Cue has just fired the guy who was unfortunately leading the Maps team at the time of iOS 6's release. If you'll recall, Cue was placed in charge of both Siri and Maps during an executive shakeup back in October, and it seems that he's clearing the runway in order to make things better in the months to come. The report also mentions that Cue is "seeking advice from outside mapping-technology experts and prodding digital maps provider TomTom to fix landmark and navigation data it shares with Apple." It's assumed that the goal here is to install a new leadership team within the Maps group, but it's unclear if it'll happen prior to Google's own standalone iOS app becoming available. For those curious as to why such a drastic move had to be made, head over to Apple's Cupertino campus and use iOS 6's Maps app to search for "convenience store." Evidently, the closest one is some 1.5 hours north in San Francisco. True story.

HP investor sues company for handling of 2 deals

(AP) ? A Hewlett-Packard shareholder has filed a lawsuit alleging the troubled technology company's top executives misled investors about two key acquisitions that have caused billions of dollars in losses.

The complaint filed Monday in a San Francisco federal court comes after Hewlett-Packard Co. stunned Wall Street last week with its own allegations of accounting shenanigans at Autonomy, a business software maker it acquired for $10 billion last year.

The lawsuit filed by shareholder Allen Nicolow alleges HP management concealed the problems at Autonomy and another recent acquisition, Electronic Data Systems, in an attempt to boost HP's stock price.

The stock has lost more than half its value so far this year.

HP, which is based in Palo Alto, Calif., declined to comment on the suit.

Gaza cleric calls violation of Israel truce sinful

GAZA CITY, Gaza Strip (AP) ? A leading Islamic cleric in the Gaza Strip has ruled it a sin to violate the recent cease-fire between Israel and the Hamas militant group that controls the Palestinian territory.

The fatwa, or religious edict, issued by Suleiman al-Daya late Saturday accords a religious legitimacy to the truce and could justify any act by Gaza's government to enforce it.

"Honoring the truce, which was sponsored by our Egyptian brethren, is the duty of each and every one of us. Violating it shall constitute a sin," the fatwa read.

The Wednesday truce put an end to an eight-day Israeli offensive against Gaza militants who fired rockets into Israel. The agreement remains fragile because details beyond the initial cease-fire have not yet been worked out.

Lord Sacks: religion can help sustain welfare state - WorldWide ...

Lord Sacks: religion can help sustain welfare state
Jennifer Lipman ("The Jewish Chronicle," November 23, 2012)

Lord Sacks has described religion as "the redemption of our solitude" during a parliamentary debate on the role of faith in society.

The chief rabbi, who will retire from his post in less than a year, suggested that while in secular times religion was often misunderstood as "a strange set of beliefs and idiosyncratic rituals", it could be better understood for its teachings about "making sacrifices for the sake of others, through charity".

"Long before these functions were taken over by the state, religious groups, here and elsewhere, were building schools and hospitals and networks of support," he said, referring to Harvard sociologist Robert Putnam's research on the role of faith groups in society.

"Not for a moment do I say that to be good you need to be religious. However, religiosity as measured by attendance at a house of worship turns out to be a better predictor of altruism and empathy than education, age, income, gender or race."

Lord Sacks went on to discuss the "social implications" of religion, for example sustaining the welfare state when the government was unable to do so. And in a remark reminiscent of his criticism last November of Apple's role in the consumer society, he added that religion could "act as a counter voice to the siren song of a culture that sometimes seems to value self over others, rights over responsibilities, getting more than giving, consumption more than contribution, and success more than service to others".

The debate was called by Lord Singh, a Sikh, who said he wanted to counter the fact that "religion today has a bad press", and involved contributions from peers of all faiths. Among those speaking was Labour peer Lord Janner, who spoke of last weekend's Mitzvah day as an example of "the Jewish community's role in society".

"It is a day when the Jewish community comes together to help society, not financially, but by giving our most valuable asset: our time," he said. "The contribution made by religious communities to our society is outstanding and we should recognise and praise their input into our country."

Baroness Neuberger also spoke, urging the government to assess the "broad lack of public understanding of the roles that faith can play in wider society".

The West London Synagogue rabbi added that the government should "consider drawing in people of faith to debates about education for everyone, volunteering for everyone and the need to learn to give and receive."

Responding, Baroness Warsi said: "This Government believe that religion plays a vital role in British society. Not only do we support people in their right to follow a faith if they choose to do so; we also celebrate faith and faith communities' contribution to society."

Sheriff: Man opened fire on 2 Alabama deputies

FAIRHOPE, Ala. (AP) ? The shootout that left one Alabama deputy sheriff dead and another in critical condition on Saturday began when they checked on a man at his mobile home and he opened fire on them, authorities said.

Baldwin County Sheriff Huey Mack told AL.com (http://bit.ly/TcX1yC ) that gunfire erupted Friday after Michael Jansen pulled a handgun on Deputy Scott Ward and his colleagues outside of Jansen's Fairhope-area home.

Ward was fatally wounded after responding about 4 p.m. with two other deputies to a family disturbance call at the residence. Deputies returned fire, killing Jansen.

Ward, 47, was transported by helicopter to University of South Alabama Medical Center in Mobile, where he was pronounced dead. The second deputy remained in critical condition at the same hospital Saturday afternoon. The third deputy was not hurt.

Mack did not release the names of the two surviving deputies.

Jansen, 53, was pronounced dead at the scene.

Mack told The Press-Register of Mobile that deputies had responded several times to deal with issues arising from Jansen's mental health. Court records show that his mother moved to have him committed in 2009 and in 2010, and that a probate judge agreed to send him to a state hospital twice in 2010. The newspaper reported that Jansen's mother had called 911 on Friday to report that he was agitated and wouldn't calm down.

A sheriff's office spokesman said Jansen was home alone when deputies went to check on him.

The county's Major Crimes Task Force was investigating the shooting, as was the department's internal affairs office. That is standard procedure when any officer is involved in a shooting.

Mack said the initial inquiry suggests deputies followed procedure.

The sheriff told AL.com that deputies approached Jansen on his porch to find out what prompted the initial call.

"That individual produced a handgun and began to fire at the deputies," Mack said. "Two of the deputies were struck by multiple gunshots."

Mack said the deputies, all of whom were wearing bullet-resistant vests, fired back.

Ward had been a Baldwin County deputy for more than 15 years, working on patrol, in the investigations unit and on the SWAT team. Before joining the Baldwin force, he was an officer for the city of Prichard, near Mobile. He was in the U.S. Coast Guard Reserve. Mack said he had recently returned from a deployment to Afghanistan. He is survived by his wife.

"Scott stood up ... and he did his job and in the course of the job he made the ultimate sacrifice," Mack said. "Tomorrow we will continue to grieve Scott, but we will have to move on. That's what Scott would want us to do because our mission does not stop."
